‘No Win No Fee’ arrangements were created to take the risk out of making a claim. With these types of claims, you will not be charged anything if you claim is not successful. However, in 2012, success fees were added to these arrangements. These fees mean that if your claim is successful, then your solicitor will receive a percentage of the compensation won.
No Win No Fee solicitors take a 25% success fee as a standard rate. This is the maximum deduction that solicitors can take as ruled by the Ministry of Justice. For example, if you’re awarded £5,000 in compensation, then your solicitor will get £1,250 if their success fee is 25%.
While this may seem like a large deduction, the main benefit of No Win No Fee arrangements is that there are no up front costs. This makes it a more realistic option for many people, giving them easier access to justice.
Solicitors charge a success fee to cover their time and legal costs. It’s in their best interest to win your case so that they can receive this amount and make a profit from providing you with their services. However, some solicitors can reduce their success fees to below the cap of 25% so that the client keeps more of their winnings.
Solicitors will sometimes reduce their success fee if they think there's little risk of losing the claim. If a strong case can be built through detailed evidence and reliable witness statements, for example, then a solicitor might consider reducing the success fee for the claim.
